The Controversial Chamberí Penthouse: A Costly Enigma for the Ayuso Administration

The Community of Madrid finds itself at the center of a controversy following the acquisition and subsequent listing of a luxury penthouse in the Chamberí neighborhood. The operation, which involved an initial outlay of 6.3 million euros and a projected sale price of 6.69 million, has raised numerous questions regarding the transparency and justification of the public funds used. President Isabel Díaz Ayuso has avoided providing direct explanations, delegating responsibility to her Ministry of the Presidency.

Uncertainties Regarding the Justification of the Purchase

One of the main unknowns revolves around why the regional government chose to buy this 485-square-meter property (featuring a 200-square-meter terrace) as a temporary headquarters. Initially, it was argued that it would be used to relocate staff due to renovations at the Sol headquarters. However, it has been confirmed that the property cannot be used for institutional purposes and is only suitable for residential housing. The City Council has corroborated that no change of use was ever requested.

Furthermore, the decision to buy rather than rent for a temporary need has been questioned, especially considering the Administration's extensive portfolio of available office space. The lack of prior reports endorsing the compatibility of use and the purchase decision, as well as the absence of details regarding the alleged renovation work until weeks after the case came to light, add to the opacity of the operation.

Lack of Transparency in the Process and Sale

Details regarding the renovations, which include a negotiated procurement file without public tender for 59,000 euros for the project design, were only published on the Community of Madrid's contract portal weeks after the controversy erupted. The bidding and execution process for the works, with an estimated budget of 1,649,495 euros, has yet to have its timelines and scope clearly defined.

The subsequent decision to sell the penthouse, announced as a measure to allocate funds for reconstruction following the wildfires in the Sierra Oeste, has also caused confusion. It had to be admitted that the allocation would be indirect, depending on the annual closing of the public company Planifica Madrid and whether the sale generates a profit. The purchase and sale agreement, signed in April, included a confidentiality clause demanded by the Community of Madrid, which further limits oversight.

Reactions and Legal Actions

The opposition has reacted firmly. The PSOE has filed a complaint with the Public Prosecutor's Office against Planifica Madrid, calling for Ayuso's resignation. Meanwhile, Más Madrid plans to go to court to obtain information regarding potential embezzlement. A private lawyer has already filed a lawsuit with the Court of Auditors, demanding detailed documentation regarding the acquisition, including appraisal reports, justification memos, and board of directors' agreements.

The location of the penthouse, right across from the president's family home, is another major unknown not addressed by the government. Municipal regulations would also not allow for the installation of offices on the top floor of the building. The strategy of using a commercial entity like Planifica Madrid, which operates under private law, reduces the standard controls of the public Administration—a practice that, according to experts, intensifies the need for justification and transparency.

The Community of Madrid, through the Ministry of the Presidency, considers that the explanations have been "more than sufficient," but the accumulation of questions and ongoing legal actions suggest that the Chamberí penthouse case is far from resolved. The sale has been put out to tender with a starting price higher than the purchase price, adding another variable to this complex real estate and public housing scenario. The lack of clarity regarding the motives and the process of this transaction highlights the need for greater accountability in the use of public resources, even when seeking to avoid the mortgaging of future funds.
